On this page you can read all the terms and conditions of RMS Vocal Institute that you need to agree and accept in order to use our services.
This page is constantly updated, any changes and new addition to our Terms & Conditions will be logged and you will be notified to review and accept the modified version.
T&CS OF SERVICE
* RMS Vocal Institute (formerly known as Rocky Music Studio) (hereinafter referred to as “RMS” or “we”, “us” or “our”) is the name of the vocal tuition and vocal coaching business specialized to deliver extreme vocal technique development as it is advertised on www.rmsvocalinstitute.com, www.rockymusicstudio.com and other various online platforms.

* Site / sites or website (hereinafter referred to as “site”, “sites”, “website”, “webpage”, “booking page”, “online platform" or "homepage") are all the publicly accessible online webpages, primarily hosted under the domain "rmsvocalinstitute.com" owned, maintained and managed by RMS.
* Service / services or session / sessions (hereinafter referred to as “service”, “services”, “session”, “sessions”, “booking”, “bookings”, “lesson”, “lessons”, "subscription", "subscriptions", "training", "trainings", "training session" or "training sessions") are all services (typically singing lessons) offered and provided by RMS.
* Customer / customers or client / clients (hereinafter referred to as “student”, “students”, "client", "clients", "user", "users", “you” or “your”) are those persons, private individuals, or private or public companies who book and/or purchase any sessions or services offered by RMS. A student is both anyone who is currently utilizing the RMS booking services, as well as those who have booked sessions at RMS or purchased from RMS in the past.
* Account (hereinafter referred to as “RMS account” or “Account”) is an account that a customer creates on the RMS website, rmsvocalinstitute.com by either registering with an email address and a chosen password, or by connecting an existing, third party account, such as Facebook or Google.
By connecting your RMS account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party sites). If you do not want information about you to be shared in this manner, do not use this feature.
* Teacher (hereinafter referred to as “teacher” or “teachers”) is the tutor or vocal coach who represents RMS and who provides our services to our students. These services can include: vocal lessons, recording sessions, classes, seminars, workshops and master classes. The teacher can be anyone who works or who has worked for RMS in the present and/or in the past.
TERMS AND CONDITIONS OF SERVICE
Please note that by booking any of our sessions or services, taking lessons or by making any purchase from RMS, you and any clients accept and agree to the following terms and conditions by manually checking the "I agree to the Terms & Conditions" box on the website. Consequently, you and any clients digitally sign the acknowledgement and acceptance of the legally binding clickwrap agreements that are included in the following terms and conditions, included, but not limited to the terms and conditions of service.
RMS Vocal Institute is an E-Commerce Site.
RMS covers both Business to Consumer and Business to Business types of E-Commerce trading.
All documents, audio or all kinds of visual materials and other teaching methods released and shared by RMS and/or the teacher during a lesson or during any other RMS services (including any advertising and marketing materials) are subject to our copyright and distribution. Copying or re-sharing any of RMS’s physical and intellectual properties and assets without the permission and/or knowledge of RMS is strictly prohibited. Any sort of recording (audio or/and video) of any sessions (including lessons, web seminars, master classes) by students or any third party without the permission and/or knowledge of RMS is strictly prohibited.
All physical and intellectual properties of RMS that you may receive on our lessons including but not restricted to RMS’s unique teaching methods, RMS's concept of curriculum and both theoretical and practical information you are receiving during RMS sessions are not allowed to use for your own or a third party’s business activity such as your own private teaching or coaching business or working for or selling these to any other third party.
You are also not allowed to publish, share or distribute any materials that are copyrighted by RMS without prior written permission of RMS. Approaching any of our currently or previously employed teachers to arrange lessons, tips, consultations or any activities that is within the RMS’ nature of business without the involvement of RMS is strictly forbidden. If we find out about any of the previously mentioned or the following attempts to avoid the RMS services provided on our booking page and paying directly to our teachers for the previously stated activities such as; vocal lessons, recording sessions etc, this will be investigated and we reserve the right to take legal action against you for causing business loss to RMS. Furthermore all of your existing prepaid bookings will not be refunded and you will be banned from taking lessons from RMS in the future.
Please note that if you break any of these terms in this section intentionally or unintentionally a lawsuit and/or copyright claim may be issued against you and we reserve the right to take all possible legal actions against the copyright and/or trademark related offences that may have been caused by you or by a third party.
Backing tracks and lyrics are provided on or after the lessons. For HOME practising we provide audio and video exercises for LEVEL R, M and S. These exercises are for improving, strengthening and training your voice to take you to the next level. Only limited exercises will be released to you upon booking a single Mini or Standard Vocal Lesson. Most of the audio exercises and other RMS teaching materials are only released to you after you purchased the 4-Pack Standard Vocal Lesson subscription or after several purchases of Standard Vocal Lessons.
This entire Terms & Conditions page (https://rmsvocalinstitute.com/terms) is not restricted or modified by any additional specific warnings or terms and conditions.
RMS Vocal Institute™ and Rocky Music Studio™ are worldwide registered trademarks and their names and logos are protected by standard global trademark rights.
RMS reserves the right to use all media content (photos, audios, videos) that are recorded by RMS or by a third party during the lessons or recording sessions (including web seminars, workshops and master classes) for educational, marketing and advertising purposes. By taking any of our services and by accepting our terms and conditions, you consent to and grant RMS the unlimited use of such materials that may show you or may display you during the services. You may not want to be seen on any of these video, audio recordings or photographs you need to send a written request to firstname.lastname@example.org prior to the recording / shooting of the particular footage. RMS will review this and will try to accommodate such requests, however RMS is not obligated to grant all such requests by any means. We also can not accept your removal request after the particular footage has been recorded and reviewed by RMS.
All major credit and debit cards are acceptable payment methods for RMS bookings, services and other purchases and they are taken primarily via Stripe ™ payment processing platform. By default RMS requests the payment to be made through the RMS website where payments will be processed by Stripe ™, Apple Pay or Google Pay. For any reason if the previously mentioned payment processing methods fail to take payment from your card, please get in touch with us and we can then offer alternative payment methods. PayPal ™ as a secondary payment option may be offered to you by RMS. In extreme circumstances direct BACS transfer can be also accepted but this will also have to be confirmed by RMS first. Cash or cheque payments are not acceptable under any circumstances.
RMS reserves the right to change fees and prices of services and sessions anytime without prior notice. All fees and prices of RMS sessions and services are displayed in GBP currency and they are inclusive of all taxes and VAT.
RMS reserves the right to change the assigned teacher of your lessons at any time in the case that the originally assigned teacher is not available to attend the appointment. When you book your RMS session on the website, you are booking a service provided by RMS and not by the particular teacher you have chosen. Therefore you can choose your teacher upon booking an RMS session but RMS cannot always guarantee the lesson(s) will be held by that instructor.
Understanding of time zones:
All students outside of the UK need to remember that the booking site and email / text notifications and reminders primarily show all appointments in your own, local time zone provided that you have set your local time zone correctly on the website upon booking your session.
However, dates and times are always displayed in the conventional UK format, such as:
DD/MM/YYYY or DD/MM/YY,
and times are always displayed in 24 hour "military" format: 08:00 means 8:00am, 16:00 means 4:00pm, 19:30 means 7:30pm etc...
Please always stick to the time that has been pre-arranged with your teacher or if you are still unsure get in touch with us via email.
RMS lessons, sessions and services via third party online platforms (SKYPE ™, Zoom ™, Google Meet or WhatsApp).
RMS offers majority of the sessions and services via various third party online video chat platforms. These are provided by SKYPE ™ and Zoom ™, Google Meet or WhatsApp video call. RMS can not be held responsible and there will be no refund issued for connection problems that disrupt or delay the lessons. It is your responsibility to create a user account on at least one of these platforms to be able to join our online calls and we can provide the services to you.
Visiting https://www.rmsvocalinstitute.com or sending emails to RMS constitutes as electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.
RMS is required to collect certain personal and private data of yours in order to use our services.
All service providers such as websites, booking page and payment processing systems that are being used in order to use our services are fully GDPR compliant and hold a GDPR certificate.
We collect some of your personal details such as your full name, address, phone number and email address. Upon booking any of our services you absolutely must provide your name and email address as a minimum. Providing any further personal data to us is not mandatory in order to purchase RMS services. We need your full name and address in order to legally issue invoices and receipts for the payments that you make to us. We need your email address and telephone number in order to be able to get in touch with you strictly for session-related matters only. We also use your email address and phone number to send notifications and reminders about your upcoming RMS sessions.
We never bother you with newsletters, promotional emails, calls or texts without your consent.
Your personal data will be read by people working at RMS only and exclusively your name and email address will be shared with your RMS teacher. No other third party can gain access to your personal data.
RMS never releases, shares or sells your personal data to any third party.
We are always able to provide you with the exact list of data that we have and hold about you upon your request, immediately.
Upon your request we will delete all your personal data from our systems, however please note that will result in the cancellation of all your existing and future bookings, and you will not be able to use our services again until you re-register yourself and share your information with RMS again.
We have made extra security measures in order to keep your data safe, for example your personal data is only stored online, therefore it is never printed or used in any physical form whatsoever.
We also use the highest online security steps in order to prevent online hackings and data theft.

The Linked Sites are not under the control of RMS and RMS is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Certain services made available via https://www.rmsvocalinstitute.com are delivered or provided by third party sites and organizations. Disclaimer for International Users:
The Service is controlled, operated and administered by RMS from our offices within the United Kingdom, as RMS is the trading name of Hekker Bros. Ltd, a company registered in England and Wales. If you access the Service from a location outside the UK, you are responsible for compliance with all local laws. You agree that you will not use the RMS Content accessed through https://www.rmsvocalinstitute.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.
BOOKING AND CANCELLATION POLICY
1. In order to book a session or services with RMS you must be at least 16 years of age or older.
3. All RMS bookings must be fully paid for in advance. Failure to clear payments within the time interval given by the payment processing platform during online booking will incur the cancellation of the session(s).
4. Please note that you are able to book an appointment with RMS with a minimum of 24 hours ahead only, so all appointments within 24 hours of the present time will be unavailable to book on our booking site. Also you are able to book up to 90 calendar days ahead of the present time but not to any future date beyond that. If you are late for your appointment it will still end at the original scheduled time and the lesson time will not be recovered.
5. You may cancel or reschedule your bookings up to 24 hours before the start of the session without being charged. If you would like to reschedule your lesson instead of cancelling it completely, you can do that in your RMS account as long as you are within 24 hours prior the time of your booking. If you wish to cancel an appointment, and you can do that in your RMS account too, and a full refund will be issued to you. Please note that refunds can take up to 5 - 10 working days to complete.
6. In the case that your bookings are cancelled or you can't show up on them within 24 hours notice prior to the lesson, the original session fee will be fully charged and no refund will be issued to you.
7. Reasons for cancellations, rescheduling and “no shows” of your bookings or being late from your sessions for reasons like heavy traffic, sickness or various last minute unexpected issues will not make an exception and all sections of our cancellation policy will still apply to you. Within a sensible reason we always try to find a way to make up lessons that you have missed due to reasons beyond your control either on discounted price or free of charge but in every case it is entirely our and your teacher's decision.
8. Rescheduling your bookings:
Rescheduling any of your bookings is only possible for a limited number of times per booking. After the original booking is made and the session has been rescheduled once (regardless whether the teacher or the student requests the change) only one more reschedule is possible and this second reschedule is the final one. If by any reason no RMS teacher can make this second appointment, a refund will be issued to the student. However if the student can not make it to the appointment, the lesson will be charged and no further rescheduling will be possible. A new lesson will have to be booked by the student in order to continue with the lessons or in case of the student having an active 4-Pack Subscription, then the next lesson in the subscription will follow, but the missed lesson will not be replaced, it will be always deducted from the subscription.
*Please note that free sessions, 4-Pack Subscriptions, appointments booked with any of our discount codes or on any discounted price are exempt from our standard cancellation policy stated above.
Sessions that are free of charge and all kinds of discounted lessons cannot be rescheduled or cancelled for any reason or under any circumstances and no refund will be released to you unless otherwise stated upon releasing the special discount code via email or social media platforms.

*Free Online Consultations*
RMS offers one consultation session to brand new students for free of charge. Remember, these sessions are not actual vocal lessons, they are consultations with one of the RMS teachers and for informational purposes only. Online consultations are available only on specific days of the week and RMS provides a limited number of sessions only. The length of the consultation session is shown as 30 minutes in RMS’s booking page, however the actual length of the consultation is typically 20 minutes maximum.
Please note that Free Online consultations can be booked only once and it is offered to brand new students only. RMS reserves the right to cancel your Free Online Consultation session anytime if we think you do not fall into this category or you already had a Free Consultation previously.
You can get a one-time 50% OFF session every time you bring a new student to us. A new student counts as someone who has never registered to use the RMS services before and must complete at least one paid lesson with RMS. Your 50% discount code will arrive soon after that via email and must be used within one calendar month. Referral must be confirmed by both the new student and the student who referred him / her.
This discount code can be only applied upon booking either a Mini Vocal Lesson or a Standard Vocal Session. The 50% OFF discount code can not be used to purchase a 4-Pack subscription.

Once the Mini Vocal Lesson is booked, it can not be transferred to another person (student) or to a different teacher within RMS Vocal Institute.
If you have booked your free Mini Vocal Lesson but you can not attend your appointment for any reason, the scheduled session can not be moved, postponed or rescheduled.
If you have not used up your discount code within 2 months or could not attend your scheduled appointment, you will lose the free lesson and it will not be replaced under any circumstances.
If you won the contest previously and you happened to answer correctly to future games again before anyone else, RMS Vocal Institute reserves the right to continue the game until the second correct answer arrives and give the free lesson to that person as whoever won our game previously automatically excludes from winning again.

Only ONE of the promotion codes above can be applied per customer. Either of the promo codes can be used once per customer only. Promotion codes are valid from 00:00 21/06/2023 - 23:59 26/06/2023 BTS (british summer time) meaning the booking and the payment must be made between this time frame.
Services booked with the above mentioned promo codes are exclusive of RMS Vocal Institute's Cancellation and Refund policy, once a lesson or subscription is booked and payment has been made the scheduled sessions can not be cancelled or rescheduled and no refund will be issued under any circumstances.

You can get four Standard Vocal Lessons (4 x 1hr vocal lessons) on a discounted price when you purchase *4-Pack Subscription* on our booking page. After getting the subscription, you can book four "4-Pack Standard Vocal Lesson"s on the website under the "Single Vocal Lessons" tab.
Please see THIS EMAIL update we sent to our customers in the spring of 2023 to get help on how to purchase these discounted lessons.
Please note that all four lessons must be completed within three months of purchasing your 4-Pack Subscription. Furthermore, all four lessons must be completed with the originally booked teacher (teacher cannot be swapped in the middle of the bundle lesson) unless RMS or your teacher decides otherwise. If you have not booked (meaning scheduled in) and completed all 4 standard vocal lessons within 3 months of your subscription purchase date, you will loose all remaining vocal lessons you originally would have been able to schedule in, and you must purchase a new subscription to continue booking vocal lessons on the discounted price. In other words, once a subscription expires, no unused lessons can be used up or can be booked with that subscription and RMS will not issue any refund to you for expired subscription payments.
As part of the exclusivity of the bundle sessions slightly different cancellation and rescheduling policies apply to these lessons:
If you cancel your 4-Pack Subscription with no 4-Pack Standard Vocal Lesson bookings deducted from it, we will refund the whole amount of the subscription to you.
If you cancel your 4-Pack Subscription with one 4-Pack Standard Vocal Lesson booking deducted from it, and you cancel the appointment outside the 24 hours time frame ahead of the start time of the lesson, we will refund the whole amount of the subscription to you upon these cancellations or reschedule the lesson for you if you just cannot make it.
If you cancel your 4-Pack Subscription with one 4-Pack Standard Vocal Lesson booking deducted from it, and you are within 24 hours prior to the start time of the lesson, or
if you cancel your 4-Pack Subscription with two 4-Pack Standard Vocal Lesson bookings deducted from it, and you cancel the second appointment outside the 24 hours time frame ahead of the start time of the lesson, we will refund the whole amount of the subscription (£200) minus the amount of one Standard Vocal Lesson (£60) to you (£200 - £60 = £140) upon these cancellations or reschedule the second lesson for you if you just cannot make it.
If you cancel your 4-Pack Subscription with two 4-Pack Standard Vocal Lesson bookings deducted from it, and you are within 24 hours prior to the start time of the second lesson, or
if you cancel your 4-Pack Subscription with three 4-Pack Standard Vocal Lesson bookings deducted from it, and you cancel the third appointment outside the 24 hours time frame ahead of the start time of the lesson, we will refund the whole amount of the subscription (£200) minus the amount of two Standard Vocal Lessons (2x £60 = £120) to you (£200 - £120 = £80) upon these cancellations or reschedule the third lesson for you if you just cannot make it.
If you cancel your 4-Pack Subscription with three 4-Pack Standard Vocal Lesson bookings deducted from it, and you are within 24 hours prior to the start time of the third lesson, or
if you cancel your 4-Pack Subscription with all four 4-Pack Standard Vocal Lesson bookings deducted from it, and you cancel the fourth appointment outside the 24 hours time frame ahead of the start time of the lesson, we will refund the whole amount of the subscription (£200) minus the amount of three Standard Vocal Lessons (3x £60 = £180) to you (£200 - £180 = £20) upon these cancellations or reschedule the fourth lesson for you if you just cannot make it.
You can only reschedule your vocal lessons in a purchased 4-Pack Subscriptions for the maximum amount of three times.
For example you can reschedule your second lesson three times (the third will be final) or once the first lesson, once the second lesson and once the third one or once the first lesson and twice the third lesson, etc.. If you have used all your three opportunities to reschedule your lessons the rest of the lessons booked with the subscription will not be moved and if you cannot make those appointments the next lesson will follow in the subscription or a new 4-Pack Subscription must be purchased.
Refunds will not be issued for missed lessons due to too many reschedules made on your behalf. You can only book a new subscription again, if all four lessons of your currently active subscription are already scheduled with your teacher.
Terms and conditions for RMS Teacher Association and for Teacher Training plans:
For those clients who are voice professionals, vocal teachers, vocal coaches, singing teachers or any other kind of businesses who’s nature of business can be identified with vocal / voice / singing tutoring, RMS created the RMS Teacher Association. All those who fall into any of the categories listed above can not purchase and take vocal lessons from RMS as private individual students can. RMS reserves the right to refuse to provide certain services to them and they can only take vocal lessons at RMS by purchasing a teacher training plan.

Currently there are two types of teacher training plans available for purchase at RMS. With the “ROCK” plan, users get sixteen standard vocal lessons (60 minutes in length each) as training to be a certified RMS vocal teacher. In the case of purchasing a “PRO” plan, users get twenty five standard lessons instead of sixteen. If you do not use up all sixteen or twenty five lessons before acquiring your RMS certificate, those remaining lessons will not be refunded. You have 6 calendar months to complete all training sessions in both “ROCK” and “PRO” plans, counting from the date of purchase. If all training sessions are used up or your 6 months period expired and you still need more lessons in order for RMS be able to issue your teacher certificate, you can book any of the services that are available for regular students on the RMS booking site. These sessions must be paid separately by you purchasing the regular standard sessions.
The decision of you being ready to be a certified RMS teacher is entirely up to the headteacher of RMS, however past experience shows that the amount of time and lessons included in the two training plans are more than enough for a voice professional to achieve the level of knowledge that they can pass on to their own clients.
RMS reserves the right to issue no refund from the purchase of neither of these teacher training plans after the occurrence of the very first session. Up to the beginning of the first teacher training session, RMS can give you an 80% refund from the original price you paid upon purchase. Under no circumstances RMS can issue full refunds from teacher training plan purchases.
RMS reserves the right to change the prices of the teacher training plans at any time without notice.
At the end of the first teacher training session you will receive an email with a Non Disclosure Agreement which you must read, fill out, sign and return to us before the second session starts. If you fail to do that your further sessions will be cancelled and withheld until you send the NDA back to us with the correct information and signatures required.
Changes to these Terms and Conditions:
We may revise any or all of the Terms and Conditions mentioned above from time to time to reflect changes to our business, the websites, booking pages or services, or applicable laws. The revised Terms and Conditions will be effective immediately as they are published.
If the revised version includes a substantial change, we may notify you of the change using email or other means.
